These Terms and Conditions govern your use of the MindfulWell website and your engagement with any services provided by MindfulWell. By accessing this website or booking a service, you acknowledge that you have read, understood, and agree to be bound by these terms.

If you are in immediate danger or experiencing a mental health crisis, please do not rely on this website or MindfulWell services as your primary source of support.

1. Nature of Services

MindfulWell provides counselling, coaching, somatic practices, workshops, group programmes, and retreat-based wellbeing services. These services are intended to support personal growth, emotional wellbeing, and nervous system regulation.

While our services may be therapeutic in nature, they are not a substitute for medical, psychiatric, or emergency care. MindfulWell does not provide crisis services, diagnosis, or medical treatment.

Participation in services does not guarantee specific outcomes or results.

2. Eligibility & Consent

  • Individuals aged 16 years and over may engage in services independently
  • Clients under 16 must have parent or guardian consent
  • By engaging in services, you confirm that you have the capacity to consent

3. Bookings, Payments & Fees

All services must be booked in advance via our approved booking system.

  • A booking fee or full payment is required to secure your appointment
  • All fees are listed in New Zealand Dollars (NZD)
  • By confirming a booking, you agree to all applicable fees and policies
  • You agree to our Cancellation Policy as part of your booking

4. Client Responsibility

By participating in MindfulWell services, you acknowledge and agree that:

  • You are responsible for your own physical, emotional, and psychological wellbeing
  • You will disclose relevant health information where appropriate
  • You will engage in services in a respectful and appropriate manner
  • You may pause or withdraw from services at any time

5. Confidentiality & Limits

MindfulWell is committed to maintaining confidentiality in accordance with ethical and professional standards. However, confidentiality may be limited where:

  • There is a serious risk of harm to yourself or others
  • Disclosure is required by law
  • Information is required for professional supervision (de-identified where possible)

6. Group Programmes & Retreats

When participating in group settings, you agree to:

  • Respect the privacy and confidentiality of other participants
  • Engage in a safe and respectful manner
  • Take responsibility for your own participation and boundaries

MindfulWell is not responsible for the actions or disclosures of other participants in group environments.

7. Website Use

  • You agree to use this website for lawful purposes only
  • You must not misuse, copy, or distribute content without permission
  • All content is provided for general information and personal use

8. Third-Party Services

MindfulWell uses third-party platforms, including Splose, to manage bookings, records, and communications. While we take care in selecting secure systems, we are not responsible for the policies or practices of these external providers.

9. Communication

By providing your contact details, you consent to receiving communication related to your bookings, services, and relevant updates. You may opt out of non-essential communication at any time.

10. Limitation of Liability

To the fullest extent permitted by law:

  • MindfulWell is not liable for any direct, indirect, or incidental loss or damage arising from your use of our services or website
  • All participation in services is voluntary and undertaken at your own risk

11. Changes to Terms

MindfulWell reserves the right to update or modify these Terms and Conditions at any time. Continued use of the website or services indicates your acceptance of any changes.

12. Practitioner Relationship

MindfulWell operates as a collective of independent practitioners. All practitioners are independent contractors and are not employees of MindfulWell.

  • Each practitioner is responsible for their own professional conduct, qualifications, and scope of practice
  • MindfulWell provides a platform for connection, coordination, and delivery of services but does not assume liability for individual practitioner actions
  • By engaging in services, you acknowledge that your relationship may be directly with the practitioner delivering your session, programme, or retreat

13. Practitioner Independence & Credentials

All practitioners providing services through MindfulWell are expected to:

  • Hold relevant qualifications, training, or professional memberships appropriate to their practice
  • Maintain their own professional indemnity insurance where applicable
  • Practise within their individual scope of competence and training
  • Uphold ethical, professional, and legal standards relevant to their discipline

MindfulWell verifies these credentials at onboarding but is not liable for the professional conduct or decisions of any practitioner. Any concerns should first be directed to the practitioner, and may be escalated to relevant professional bodies if necessary.

14. Service Process & Continuity of Care

Session frequency, duration, and structure are agreed collaboratively with the practitioner based on individual needs. Ending or transitioning support should be planned and communicated appropriately.

Practitioner Availability:

  • If a practitioner becomes unavailable due to illness, leave, or unforeseen circumstances, MindfulWell will take reasonable steps to notify you
  • Where possible, MindfulWell will support transition to another suitable practitioner
  • Guidance will be provided if alternative support is needed

MindfulWell is not liable for interruptions to services arising from practitioner unavailability provided reasonable steps are taken to support continuity of care.

15. Not a Crisis or Emergency Service

MindfulWell and its practitioners do not provide crisis or emergency mental health services. Services are not a substitute for urgent care.

If you are experiencing thoughts of self-harm, are at risk of harming yourself or others, or require immediate support, contact emergency services (111) or a crisis support line immediately.
  • Clients are responsible for seeking appropriate emergency support
  • MindfulWell and practitioners are not liable for harm arising from failure to seek crisis or emergency care

16. Company, Charity & Intellectual Property

MindfulWell is a registered New Zealand company and operates in alignment with charitable or community-focused initiatives.

  • All content, materials, frameworks, branding, and resources are the intellectual property of MindfulWell unless otherwise stated
  • “MindfulWell” branding elements are protected trademarks and may not be used without written consent
  • Unauthorized use of MindfulWell intellectual property may result in legal action
